SC to hear Tamil Nadu's plea for power today

The Supreme Court will Thursday hear Tamil Nadu's petition seeking direction to the union government to allocate it the surplus electricity that Delhi is surrendering

The Delhi government has decided to surrender 230 megawatts (MW) of round-the-clock power and 1,491 MW of power from midnight to six a.m. allocated to it for the winter months.

Soon after senior counsel Ranjit Kumar made the plea, the apex court bench of Chief Justice Altamas Kabir, Jutice S.S. Nijjar and Justice J. Chelameswar directed that a copy of the petition be given to Attorney General G.E. Vahanvati who would be assisting the court.

The court directed the listing of the matter Thursday.

The Tamil Nadu government Oct 29 moved the apex court seeking to restrain the union government from allocating the surplus power to any state other than it.Tamil Nadu Chief Minister J. Jayalalithaa, the petition said Oct 5, requested the union power ministry that it might reallocate the surrendered electricity to her state which was facing a severe power shortage.

Jayalalithaa in her letter, said the petition, had also requested the ministry to arrange necessary transmission corridor for availing the electricity .The petition also said that despite the fact that the Tamil Nadu government had approached the union government Oct 2, 2010 on the issue, there was no response from the power ministry. "It is the right of Tamil Nadu to demand the surrendered power to meet extreme power shortage," the petition said. It also said that the union government had failed to provide adequate infrastructural facilities as mandated by the Electricity Act, 2003.
